Charges dropped in Ricin case!

Paul Kevin Curtis was released on Tuesday after charges were dropped in the case of the ricin letter sent to Obama and members of congress. The Feds are citing "new information" with few other details. The charges were dropped "without prejudice," so they can recharge him later.

Since his arrest last Wednesday he and his attorney have denied all involvement the the sending of these letters. Curtis's attorney Christi McCoy claimed in an interview with CNN that her client had be framed.

"I do believe someone who was familiar and is familiar with Kevin just simply took his personal information and did this to him," -McCoy

He was released after a search if his home, his car and his ex-wife's home turns up no evidence. The FBI said they found no evidence of ricin, castor beans or any apparatus to produce ricin.

"There was no apparent ricin, castor beans or any material there that could be used for the manufacturing, like a blender or something," said Agent Brandon Grant in court as reported by The Associated Press.

According to Fox News sources the FBI was checking into the claim Curtis had been framed by a neighbor with a grudge. Also, the FBI said they had searched the home of another suspect. No information as to what that search yielded.

The question many have is why was he arrested in the first place? A few things led to his arrest:

  • The letters had the exact same phrase in them as a recent post Curtis made on his Facebook account "To see a wrong and not expose it, is to become a silent partner to its continuance."
  • The letters used the same sign off line as many of his post on places like Facebook
  • When the FBI was questioning one of the congressmen, who was to receive one of the letters, his name came up. 4) the bombing in Boston had law enforcement on high alert.

It appears the FBI unfortunately let fear and speculation rule the day. With no suspect in the Boston bombing and then these ricin letters there seemed to be fears that they could be related to each other. So they found a guy that used the phrases In the letters on social media and he was then arrested.

Many will argue the FBI didn't have cause to arrest him, but the FBI says the evidence they had was enough cause to detain. Mr. Curtis in this case.

The fact remains, with or without cause in this particular case, the FBI and other agencies of our government appear to run with close to no supervision and at times completely outside of the laws of our nation. For example the fast and furious debacle and ever the Olympic bombings in Atlanta.

In the end, our government agencies may need more supervision, but must still be able to effectively do their jobs. On the other, hand something needs to be done with policy to prevent completely innocent Americans from spending time in jail with weak circumstantial evidence. Cases like these have a history of destroying the lives of those wrongly accused and jailed. Because just because the charges are dropped it does not mean the public's presumption of guilt goes away with it.

Breaking news: Boston bombing UPDATE

News this afternoon is that the only living suspect of the of the Boston bombing, Dzhokhar Tsarnaev, was charged today by a federal court. He was charged with Use of a weapon of Mass Destruction and Malicious Destruction of Property Resulting in Death, according to the complaint filed by the Federal Government.

In other news, the White House said that the bombing suspect would NOT be treated as an enemy combatant. Thus, he will tried in the civilian legal system instead of a military tribunal. Though many in our government are calling for the suspect to be treated as an enemy combatant, we must also remember the murder/terrorist suspect was an American citizen. Either way he could face the death penalty if convicted.

(Dzhokhar Tsarnaev Boston bombing suspect)

Earlier in the day, we learned the suspect was at moments alert and answering question by nodding his head and possibly via writing although some reports were not clear. Check back here at F.P.V. for further updates on the Boston bombing as more facts come to light..

CISPA: 4th Amendment under attack??

Fourth AMENDMENT:

"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

Last week while Americans were focused mainly on the disasters in Boston, MA and West, TX. The U.S. House voted 288-127 to pass the Cyber Intelligence Sharing and Protection Act, better known by its acronym CISPA. CISPA is aimed to preventing cyber attacks but could it be infringing on your 4th amendment rights?

Proponents of CISPA say this bill would make it easier to detect a cyber attack before it became an issue or prevent them altogether  They cite recent cyber attacks by North Korea(DPRK) and even China as reason for CISPA. Others say it could even help gather intel to help prevent future terror attacks.

"In the case of Boston, there were real bombs...In this case, they are digital bombs – and these digital bombs are on their way." -Mike McCaul, House Republican from Texas

The question is it worth cost?

Opponents of the bill say its going too far in the name of security. Saying that it tramples your 4th amendment right against unreasonable search and seizure. They may have a valid argument here. Under CISPA private companies like Facebook and Google would be able to send all your personal information to government agencies such as the NSA or even the FBI if they saw fit. This includes all Internet activity: Websites visited, health records, financial records and even your bank account. All of this without a warrant. Which does violate your 4th amendment rights.

Anonymous, the cyber "hacktavist" group has called for an Internet blackout on Monday April 22. It is calling for websites owners and web developers to black out their websites for the entire day. This was done before when CISPA and its sister legislation SOPA were making the rounds in 2011. Will it have a similar effect?

In 2011 this same bill past the house, but after a massive uproar with the American public the Senate shelved the bill.

So back to the question is it worth the cost? Should give up our personal liberties to prevent the possibilities of cyber attacks? Many seem to think so. Just look at the post 9/11 Patriot Act as precedent.

On the other hand this kind of law could lead to even more Censorship something this writer is strictly against. So if you do not like the idea of the government "warrantlessly" gathering all your personal Internet information call your senators ASAP. Let them know you do not support this bill and they will lose your support in their next election.

The heroes of Boston and West

(via people.com) First responders rescue little boy in aftermath of Boston bombings

It is the end of a very rough week here in our United States. The events of this week between the Boston bombing that killed 3 and left many many more horribly injured. As well as the devastating explosion that leveled a large part of the small town of West, Texas that killed 14 people and injured a large number of folks.

This has been a tough week, but as we Americans always do we'll pull together and get through these tragedies as a family. This is just what we do.

Let's not focus on the bad, let's shift our sights to the heroes of Boston and West. The first responders to both of these events. People of all kinds civilians, EMTs, military and police. Some of these folks gave their lives to help their fellow Americans. When the chips were down these folks ran in simply to save lives.

In Boston spectators and runners alike jumped in to rescue people. In West, Texas volunteer firefighters rushed to a fire and then the explosion hurt and killed some of these Heroes. Even as they saw their fellow firefighters go down the rush in to help.

In both events we saw the true spirit of America. The spirit that we must help our fellow Americans even if it means putting our own well being in jeopardy. These folks are real heros.

(via http://www.dailymail.co.uk)

Everyone of them should be proud to know their actions saved many lives. Personally I would like to thank all the people who jumped in to help save everyone they could in the face of such horrific events. They should be commended.

In the coming days, weeks and months keep the victims of these tragedies in your thoughts and prayers.

"We got him!"

                       "We got him!"

This was the headline out of Boston last night. This headline brought a sense of relief to residents of Boston and everyone across the U.S..

The speculation has now moved on to the why and who else may have been involved if any. To this point the authorities seem confident that these two acted alone. Of course this is still an ongoing investigation if things change we will update this post.

We must not jump to any speculation we here from the mainstream media. Nor should we jump to a conclusion of why they did this until all facts have come out.

Here at FPV blog we are not going to get into all the Alex Jones type conspiracy theories. We are trying to find all facts we can before posting anything on the bombing.

There has been much misinformation from the news on this subject, mostly caused by CNNs John King not vetting his sources before calling his info. as fact. So we will not join in this kind of speculation.

So as it stands one suspect 26, dead. The other 19, is in custody and in the hospital after sustaining serious injuries in the shootout that killed his brother. Also, the Feds have said they were not going to Mirandized the suspect when or if they caught him opting for invoking the public safety exception.

Shame on the NRA owned congress!!!

46 just a number right? No, in this case it is very significant. It is the exact number of U.S. Senators who voted to support a filibuster against a bill supported by 90% of Americans, including many NRA members. They voted no on the Universal Background Check bill yesterday In a 54-46 vote.

Yes you read that right the bill lost by winning the vote. Due to some procedural finagling in the deal that got the senate to open debate without filibuster. These provisions required a 60 vote supermajority to make the bill law or it would be filibustered.

46 senators including 4 democrats voted to not prevent criminals or the severely mentally ill from obtaining firearms.

Before the vote, the NRA had spread lies to many paranoid gun owners, saying the bill would create a national database of gun owners. This was completely bunk as this had already been made illegal in 2006 and again in this new background check bill was reiterated.

These senators ignored the people who elected them. Instead they bowed to money from the Gun Lobby. This is simply an act of cowardice by our elected officials and it is appalling.

This is a symptom of a larger failure of our political system. We now have a congress completely controlled by which lobby pays them the most and this vote proves that yet again.

We must not let up on this appalling act of cowardice. We must move forward and if we must use this vote as a rallying cry for the 2014 elections. This means voting out everyone we can that went again 90% of the American voters.

If you do not support this act of cowardice by our congress let your voice be heard. Call them, Email them, find them on Facebook. Do not be ignored.

These are the 46 who ignored 90% of American voters:

Major explosion in West, Texas

Yesterday evening around 8pm a major explosion ripped through a fertilizer plant in the small town of West, Texas.

According to news reports from WFAA in Dallas, Texas up to 4 blocks of the town have been damaged or destroyed.Reports at last check put the injured at 200 or more and early reports of 60-70 dead. Neither had been confirmed. According to Waco PD they had only confirmed 15 deaths from the blast.

The fertilizer plan had some how caught on fire and led to the explosion. It cased more fire as the embers blew into the sky.

At one point reports said the entire town was being evacuated out of fear of another possible tank explosion.

We will update as we get more news.
UPDATE:
8:45 am: Waco PD spokesman says the deaths are 5-15 but can not confirm the number as of yet.

Bombing in Boston

As we all know there was a bombing at the Boston Marathon on Monday. In the attack 3 were killed including an 8year old boy. When these events take place we as a nation always pull together and this time will be no different.

This blog refuses to get wrapped up in the ever changing story of this tragic event. We will post a well rounded piece on the Boston attack when more of the facts are nailed down in order to bring you the best information.

What we will talk about here and now are two things that both sicken many and irritate rational people no matter your political leanings. One is the Westboro baptist church the other is Alex Jones.

First, The Westboro Baptist Church has decided they will protest the funerals of the victims, Including the innocent 8 year old child. Claiming God killed the because of gay rights. These folks are the lowest form of scum the earth has to offer. They do have a right to free speech sure, but they could simply learn some respect for others who are grieving the death of a loved ones. F.P.V. fears one of these days their hate speech will spark bloodshed and their children or other innocent bystanders will be caught in the middle. Their kids know no better as they have only been taught to hate and do not deserve to be caught in the middle of violence.

Now for Alex Jones. This man and his "reporters" are simply lame. Right after the bombing they jumped right to the conclusion that this had to be some "false flag" attack perpetrated by the federal government. (No evidence supports this by the way.) This is a very tired line Alex Jones uses every time tragic things happen in this Nation. His wild conspiracy claims are almost always unfounded. The fact he makes all his money solely on a small part of the populations fears is sick. All this kind of talk does if fan the flames of hate and fear. By spreading his lies across the Internet via His YouTube account and websites.

It could be weeks, months or even years before we track these cowards down. So until then all we can do is carry on like we do and not let these cowards interfere one bit in how we live our everyday life.

In the end, we must refrain from making snap judgements on this tragedy. Lets get all the facts then make an informed decision based on that. Not rush to judgement on any one group of people or religious group.

GUN VIOLENCE VICTIMS DESERVE A VOTE!!!

Many in the US seem to think their gun rights are under attack. They feel that the federal government is trying to take their Second Amendment rights away. Even more seem to think that president Obama's call for gun control reform is simply code for some sort of socialist power grab. This is not the case by any stretch of the imagination. Many appear to just simply being misinformed on what the president has really asked for.

President Obama never called for anyone to have their guns taken from their homes. However, he did call for a ban on the manufacture of assault weapons and limit on the size of magazines. As most know an assault weapons ban is nothing new to the US. One was in effect between the years of 1994 and 2004 when the Bush administration allowed to lapse. During that 10 year period we did not see the end of the world as gun owners knew it, the federal government didn't come in and steal everyone's guns, and in some instances crimes involving these particular weapons went down. So I so weapons ban would not be the end of the world nor would it affect current owners of these type weapons. This type of legislation does not appear to be on the docket anytime in the near future. What is on the table now you may ask?

On the table currently in Congress is simply a plan to close all loopholes in the background check system. The aim is to prevent criminals and those with extreme psychological disorders from obtaining any kind of firearm, whether it be an assault rifle or pistol. The NRA seems to feel that this is an infringement on the Second Amendment forgetting the fact that the Second Amendment does state in its first three words the phrase "Well Regulated" ("A well regulated militia, being necessary for the security of a free state, the right of the people to keep and bear arms, shall not be infringed"). At last check overall 90% of the American public supported universal background checks. So why should we allow the NRA to use their money and their lies to continue to shape the gun laws in the United States?

The answer is that we should not allow the NRA to continue to write our gun laws. The sad fact is that the NRA does not support American gun owners, as they once did, they simply support the American gun manufacturers. The NRA receives massive amounts of money from the makers of guns in order to lobby Congress and other officials to cut down all gun regulations in the country to increase gun sales. In the end  they are simply no better than any other lobbyist group.

The NRA's Wayne LaPierre even testified before Congress stating that background checks don't keep all criminals from obtaining a gun, so why should we have background checks all? This is the most asinine argument yet. Under this illogical thinking we should not have any laws on the books because we can't stop everyone from breaking the law. It's like stop signs, occasionally somebody will run a stop sign, does this mean we as a society should stop having laws about stopping at stop signs. This is by far the worst argument the NRA has made to this point to block background checks

If over 90% of Americans support universal background checks why can it not be done? Prior to the events of this week 13 Republican senators had stood in support of filibustering a vote on this exact proposal. Ted Cruz, Mike Lee, Rand Paul seemed to be leading the charge on that idea. Even with these 13 senators threatening a filibuster it now appears that the filibuster will not happen. This vote is slated for later today to start the debate on a bill for Universal background checks. The fact is this bill with all the support it has with the American people it deserves a vote in both chambers of Congress.

Recently, president Obama has spoken in places like Colorado and Connecticut on how important expanding background checks to all gun sales is if we want to keep guns out of the hands of criminals and the criminally insane. In Connecticut, Mr. Obama reiterated his position he had stated in his last state of the union address. As he said then the children and teachers of Sandy Hook deserve a vote.

On the other hand we have people like Sen. Inhofe of Oklahoma who feels entirely different about the victims and the families of the victims of the Sandy Hook shooting. He attempted to shame the president for involving these families in the debate for universal background checks. He claimed that the gun reform bill, heading for a vote in the near future, has absolutely nothing to do with the families or their deceased loved ones. This kind of view is absolutely repugnant. This bill has everything to do with these families and the families of every victim of gun violence. It doesn't matter if it was in a mass shooting or in a single one-on-one confrontation. All the victims of gun violence deserve a vote and deserve to have their voices heard.
I can already hear the detractors screaming what about mental illness, what about the video games and what about violent movies in Hollywood. The truth is sure these must all be dealt with maybe with stronger rating systems on video games and movies and more support for people and families dealing with mental illness.

There is really no proof that violent movies or video games are the root cause of gun violence in America. That said, more should be done to keep our children away from violent movies and violent video games. This all starts at home. Parents must do a better job of monitoring the video games their children play as well as what they see on TV or in movie theaters. These two industries could still do a better job of informing parents on what exactly each rating in their rating systems mean.

The mental health issue is not one that can be ignored but also it is not something easily controlled. The best we can do is keep guns out of the hands of those with severe mental disorders. This can be easily accomplished through a universal background check system. As of now if you are a criminal or you are mentally ill you can simply go to a gun show and find a weapon or buy one from a buddy and use it to commit crimes.

Many say that all background checks to this prevent legal law-abiding citizens from having guns, this couldn't be further from the truth. The fact is millions of convicted felons or folks otherwise not allowed to have guns have been blocked from purchasing firearms since background checks were first instituted. Plus, background checks cannot possibly prevent law-abiding citizens from having firearms. After you fill out the background check information and you pass the background check being a law-abiding citizen you are then able to buy the firearm you are wanting.

All this said, don't let the fear mongering from folks like the NRA and other like-minded groups scare us away from passing universal background checks because of the boogie monster under the bed.

Decriminalize Marijuana? Part 2

Many view addicts as losers who can not control themselves or are bad people in general. This view is completely off-base. There are many factors that may lead a person down the path of addiction. In this segment of Decriminalize marijuana? We will look at a few of these factors.

The Mayo clinic says there are two main factors to drugs use including marijuana. These factors are Genetic and environmental. Some people's genetic make-up make them more likely to become addicted to one substance or another. For others family norms and peer groups can lead them to try drugs for the first time.

There is also a link between drug use and mental health disorders. Many try illegal drugs to self-medicate things like depression. Also, some have tried the drugs from the big pharmaceutical companies for depression or anxiety and they have either failed or had very unpleasant side-effects.

So many try marijuana and it can lessen the effects of depression and anxiety and for many with fewer side-effects at least for a short time. These people really feel this is their best option to get relief from their mental health issues. This leads to another question. Is marijuana addictive?

According to many Psychologist they say yes. Adi Jaffe Ph.D an addiction researcher for UCLA says there is the ability to become addicted marijuana. This is because of the interaction between the cannabinoid receptors and the opioid receptors in the brain. He says the potential for addiction to marijuana is very low.

This may explain why many users of marijuana have no trouble quitting the substance.

The FPV take:
The fact is many use marijuana (and other drugs) to self-medicate mental health issues and research in the past has shown that many homeless people in America have both drug addiction and at least one mental health issue. For many their mental health problems lead them to drugs before or even after treatment from drugs from big Pharma. So do not just look at pot smokers as losers because they could be trying to mask the pain they are really going through.

This is part 2 of 3 in this series on the decriminalization of marijuana. Keep a lookout for part 3 in the near future.

American Owned and Staffed!!!

A recent story from Fairview Texas via. WFAA.com of of Dallas Texas pitted locals verses a local Nail Salon in Fairview.

Without going into to many nit picking details the story goes like this. The nail salon owner placed a sign in her window that states "American Operated, American Staffed. Some local Asian business owners as well as a local man who has adopted his kids from Asia are feel offended or singled out.

According to WFAA 8 of Dallas the offended parent has offered to buy a new sign that is less offensive. The nail salon owner has said no because to her it is not offensive. She said she just wanted folks to know her business was American run. So a stalemate is the result.

The story from WFAA.com http://www.wfaa.com/news/local/collin/Patriotic-or-offensive--Nail-salon-sign-at-center-of-Fairview-flap-200933761.html

The FPV take:
First, people need to stop being so easily offended by every little thing they see or hear. Second, as long as she isn't discriminating by using race as a factor in hiring who really cares. This owner makes it clear if you are not an American citizen you need not apply for a job at her shop. Last, this is what we need more of,business owners who refuse to hire illegals.

So we should applaud this small business owner for hiring Americans over folks here illegally.

Texas vs. Medicaid Expansion

Many high profile Texas politicians including Rick Perry, Ted Cruz and John Cornyn have been adamantly against this program from the Federal Government.

Many other states run by republicans and democrats a like have signed up for the expansion of Medicaid most notably Arizona and New Jersey.

Texas along with most of the south has been refusing to sign on. The issue in Texas is that state lawmakers are not seeing it the same way as the governor and the representatives in congress. Many state legislators would like to sign on.This may be due to many of their constituents supporting the expansion as well. Even a large number of Doctors and hospitals in the state support this move. So this may be pushing the folks on the state level, minus Rick Perry, to support this expansion.

Also, many in the Texas health care industry say that the Medicaid expansion will create some 200k jobs if signed on to. The job creation seems to be creating the biggest buzz among Texans on bot sides of the aisle

The FPV take:
No matter the side you are on with the affordable care act we must live with it as the Supreme Court says it the law of the land but the states can opt out of the Medicaid expansion.

Here at FPV the thought is your tax money is going to fund this new expansion so as a Texans who send more to DC than you get back, shouldn't the state reap those same benefits that states like New Jersey?

Plus, you add the thought of 200,000 jobs added to the Texas economy why would you not support the expansion of Texas Medicaid.
